MINUTES OF FRANKLIN ZONING BOARD OF ADJUSTMENT

THURSDAY, SEPTEMBER 17, 2020 AT 6:00 P.M.

ZOOM VIRTUAL MEETING

 

PRESENT:  Jim Pivirotto, Paulette Tatro, Wesley Kempton, Bob Irish.

PRESENT TO GIVE TESTIMONY: Vanka Menard

 

Paulette Tatro/Bob Irish makes a motion to open the hearing at 6:03.  Oath given to member present giving testimony. 

 

MATTER BEFORE THE BOARD:

Donald & Vanka Menard have submitted an application for a conditional use permit under the provisions of Sec 4.1:(A)(7) applicability and Sec 3.4 table (A) allowable land uses of a single family seasonal dwelling in the Shoreland/Recreational District.  Mr. & Mrs. Menard are applying for a permit for an addition of a screened porch and kitchen space on their seasonal cottage for property located at 488 Patton Shore Rd in Franklin.

 

Jim opened the hearing and read the recommendation of Wendy, Zoning Administrator.  All the setbacks, road frontage and lot size (approx. 29,000 sf) conform with the regulations.  The property lies within the 500 feet of mean water level which is conditional use.  The above changes, including the permitted proposed deck, do not “alter the essential character of the neighborhood”.  It is my recommendation that the above construction be allowed as proposed.  

 

Vanka Menard stated the need to add on to the kitchen that is very small; the outer wall is just lath and boards and makes sense to just add onto the same area as it currently exists.  Also want to add a deck to the front of the camp.  Paulette asked if camp is on the lake or across the road. Vanka-it is across the Patton Shore road on the upper side about 300 ft from the lake.  Bob are you moving or adding any plumbing fixtures; no. 

 

Bob I/Wesley K made a motion to close the hearing of Donald & Vanka Menard and enter into deliberative session.  Thanked for participating.

 

Board entered deliberative session and discussed the hearing testimony.  Bob Irish sees no reason not to approve, knows the camp and sees no issue with drainage or layout of the property.  Wesley states does not seem to be a large change to character.  Paulette-will improve the value of the property and sees no issue.

           Vote of the four board members present is unanimous to approve the conditional use permit for construction at 488 Patton Shore Rd.

 

 

 

Jim stated need to approve minutes of previous hearings of D&L Elwood and  R&L Richard on August 20th  and H. Wright on August 4th.  Paulette advised on the Richard hearing there is an incorrect name to be changed; Lisa will fix.  Bob I/Wesley K made a motion to accept the minutes of the three hearings with the change of spelling of name.  All members voted in favor, 4-0; motion passed.

 

Jim P/Paulette T made a motion to adjourn this hearing at 6:17 pm.  Motion passed.
