Meeting called to order at: 7:35 pm
Approval of Minutes: Rolland moved to approve the minutes from July 16, 2019. Dave seconded the motion. All approved the minutes.
Old Business: Development regulations review; the section 5.1 of subdivision states for 2 lot subdivisions the ZA shall review and submit to the planning commission for final decision.
New Business: Clark discussed the request of the selectboard for input on year round use at the lake. Peter K advised it used to be in the zoning regulations that we could adopt camps to year round use if they met certain requirements and the lot size requirement could be waived. Clark asked about the concerns of the guests. Joanne Rosploch advised they have concerns of campers living on Hill Rd at the lake year round and should not be. Clark states the development regulations are for new development, the older existing camps are grandfathered. To change use of camps to year-round would have to get year-round septic use state approval and potable water. Clark discussed a variance of lot size could be looked at on a case by case basis if other conditions are met. It is up to Mr. Meunier to enforce the leases for seasonal use only on his land. The change of use has to be changed by Mr. Meunier in his lease to allow year-round use. Rosploch states they are outside of the 500ft range of the lake shore district and have two double lots. The road will always be a private road. If they have one acre with the combined lots they would be ok for conversion to year-round use with the proper septic. Any ROW that are in deeds need to be left open for use by all owners, can’t build on the ROW or block it. How to stop the violations of year round living here is the concern and who needs to address the issue. There are campers on one property with extension cords running across the road, not sure where the waste is going if being lived in. Mr. Meunier is where this needs to start for enforcing his leases.
Clark’s view point on notification of subdivisions needs to be followed as written in regulations by the ZA. Clark is always being asked about the junk enforcement at homes that are unsightly. Dave advised that the selectboard will only act on complaints that are in writing.
Clark reviewed the conditional use table for change of use from seasonal to year-round. The Planning Commission would like to request that any camp that comes to the ZBA for a conditional, change of use for lot size variance, we need to set our own conditions, for the conversion to year round to be reviewed by the Planning Commission. Require state approved septic, off road parking of two vehicles. The lease needs to be amended by the land owner to allow year-round use. If the lease states it is seasonal, the PC is done and will not act on it any further. Seasonal dwelling definition was reviewed.
The next regular meeting of the Planning Commission will be held September 17, 2019.
